Welcome to Chef Asif. These Terms of Service (“Terms”) govern your access to and use of chefasifny.com, shop.chefasifny.com, and any related services, sales, or bookings (collectively, the “Site”), operated by Jackos Management, Inc., doing business as Chef Asif (“we,” “us,” or “our”).
By visiting our Site, purchasing something from us, or booking a service, you engage in our “Service” and agree to be bound by the following Terms. If you do not agree to all the terms and conditions of this agreement, then you may not access the Site or use any Services.
1. General Conditions & Site Use
We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or any contact on the Site through which the service is provided, without express written permission by us.
You may not use our products or Services for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.
2. Accuracy, Completeness, and Timeliness of Information
We are not responsible if information made available on this Site is not accurate, complete, or current. The material on this Site (including menu descriptions, pricing, and availability) is provided for general information only and is subject to change without notice. We reserve the right to modify the contents of this Site at any time, but we have no obligation to update any information.
3. Modifications to the Service and Prices
Prices for our products, weekly menus, and private services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
4. Food Safety, Allergies, and Dietary Restrictions
Please read carefully: While we take extreme care in preparing our meals and are happy to accommodate simple substitutions when possible, our kitchen processes common allergens including, but not limited to, dairy, eggs, fish, shellfish, tree nuts, peanuts, wheat, and soy.
We cannot guarantee a 100% allergen-free environment. By utilizing our Services, you acknowledge and accept that cross-contamination may occur. Jackos Management, Inc. will not assume any liability for adverse reactions to food consumed, or items one may come into contact with, while eating our products.
5. Delivery and Risk of Loss
For weekly meal deliveries and a la carte drops, we package our food in premium insulated packaging with cold packs designed to maintain safe temperatures during transit. However, once a delivery is completed (e.g., dropped off at your specified address, handed to a concierge, or left at a gate), the risk of loss and responsibility for the temperature control and food safety of the products transfers immediately to you.
It is your responsibility to refrigerate perishable items promptly upon delivery. We are not responsible for spoiled food resulting from packages left unattended for extended periods after delivery.
6. Billing and Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
7. Policies for Refunds and Cancellations
Your use of our Services is also governed by our Return & Refund Policy, which details our strict cancellation windows for private dining, event catering, weekly meal prep, and perishable goods. By agreeing to these Terms of Service, you also acknowledge and agree to the terms outlined in our Return & Refund Policy.
8. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, recipes, and software, is the property of Jackos Management, Inc. or its content suppliers and is protected by United States and international copyright laws. You may not use our intellectual property without our express written consent.
9. Limitation of Liability
In no case shall Jackos Management, Inc., our directors, officers, employees, affiliates, agents, contractors, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service.
Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
10. Indemnification
You agree to indemnify, defend and hold harmless Jackos Management, Inc. and our subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
11. Governing Law
These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New York, United States.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
